lot-0000, title: evaluation of the besar, description: the federal republic of germany is obliged to comprehensively evaluate state aid regarding direct and indirect effects on the aid recipients, the necessity, suitability, and appropriateness. the special equalization regulation according to §§ 28 ff. energy financing act (enfg) is an exception provision under which electricity-intensive companies and other eligible parties can achieve a limitation of the levies according to § 2 no. 17 enfg. the besar, which is required for the kwkg levy and the offshore grid levy, was adapted in 2022 to the new climate, environmental, and energy aid guidelines (kuebll) of the european commission and incorporated into the new enfg. for the special equalization regulation for electricity-intensive companies according to §§ 30 ff. enfg and the production of hydrogen in electricity-intensive companies according to § 36 enfg (besar), it was agreed with the european commission within the framework of the aid procedure that a first report, including a revised evaluation plan, will be submitted by the end of 2025. this report is to be presented in the form of an independent external expert opinion.
