Mr. Nguyen Tien Du (Hanoi) asked, which groups of people eligible for social housing support policies do the regulations on average housing area of less than 15 m2 floor/person in the Housing Law apply? Ordinary households and individuals (not members of the armed forces) who have a house owned by them but the average area is less than 15 m2/person are considered eligible for housing? to buy social housing or not? According to Mr. Dus reflection, currently, people belonging to normal households with narrow houses (less than 15 m2/person) have difficulty getting confirmation of this condition. He asked, which agency (the Peoples Committee of the commune/ward where the house is located, or the land/housing management agency) has the authority to check, determine and sign to confirm the form proving the narrow housing area conditions for ordinary people? Ministry of Construction Answer this issue as follows: At Point a, Clause 1, Article 78 of the 2023 Housing Law, it is stipulated: Article 78. Conditions for enjoying social housing support policies 1. Subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law to buy or rent-purchase social housing must fully meet the following conditions: stipulated in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law, in order to buy or rent-purchase social housing, you must not have a house under your ownership in the province or centrally run city where that social housing investment project is located, must not have bought or lease-purchase social housing, and must not be entitled to any form of housing support policy in the province or centrally run city where the investment project is located. Invest in building that social housing or own a house in a province or centrally run city where there is a social housing project but the housing area per capita is lower than the minimum housing area; cases specified in Points b, c, d, dd, e and g, Clause 1, Article 45 of this Law must not be living in official housing 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing: Article 29. Housing conditions 2. In case the subjects specified in Clause 1, Article 77 of the Housing Law have houses owned by them but the average housing area per capita is less than 15 m2 of floor space/person. The average housing area per capita is regulated defined in this Clause are determined on the basis of including: the applicant, his/her spouse, father, mother (if any) and his/her children (if any) registered to permanently reside in that house. Within 07 days from the date of receiving the application to confirm the average housing area per capita, the Commune Peoples Committee shall make the confirmation for the cases specified in this Clause. Form No. 03. Documents proving housing conditions for approval buying, renting and purchasing social housing/housing for the peoples armed forces (in cases where there is housing but the average housing area per capita is less than 15 m2) Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law, Section No. 9 footnote 12 has listed in detail the target groups to guide citizens in filling in the correct information for the target group.
