๐ Tender Overview
The Office of the Comptroller General of the Republic identified overpayments for the acquisition and installation of the medical gas system for the San Juan Bautista Health Center, which generated economic damage of S/202,052.
The specific control report No. 073-2023-2-5335 concludes that the Regional Government of Ayacucho did not make an adequate market inquiry in the acquisition and installation of the medical gas system, since they awarded the good pro to a bidder who did not comply with accrediting experience in the specialty and subsequently signed the contract despite the fact that the contractor delivered the documents on time.
It was also noted that 279 days after the signing of the contract, a document was entered irregularly, in which it described unit prices that were not established in the contract, which evidenced favoring the contractor with the payment of higher costs of S/ 202,052. These actions violated the Single Harmonized Text of the State Procurement Law and its regulations; as well as, the sixth clause of the same contract.
It is worth mentioning that the infrastructure and implementation of the San Juan Bautista Health Center is being carried out by direct administration, with an investment of S/75,056,952. Its construction began in 2013 and to date, after 10 years, it has still not been delivered for the use of citizens.
As a result of the subsequent control report, 9 officials were identified with alleged criminal, administrative responsibility of the entity and Administrative Sanctioning Procedure (PAS).
This report was communicated to the Office of the Special Prosecutor for Corruption Offences in order to initiate criminal proceedings, to the investigating body of the Office of the Comptroller General of the Republic for prosecution in accordance with its competences, and to the same entity for the demarcation of the corresponding responsibilities.
