Chairwoman of the Social Committee Nguyen Thuy Anh said that in the process of receiving and revising the draft Law, the Standing Committee of the Social Committee presided over and closely coordinated with the Standing Committee of the Drafting Agency, the Standing Committee of the Legal Committee and relevant agencies, strictly implementing the provisions of the Law on Promulgation of Legal Documents, thoroughly grasping and seriously implementing the direction of the General Secretary and the Chairman of the National Assembly, and the Standing Committee of the National Assembly on innovation in law-making thinking. The draft Law has ensured the correct objectives set out when drafting the Law. Up to now, basically, there are no more different opinions among agencies on major contents.
Regarding labor registration, the Standing Committee of the Social Committee has revised the regulations to provide clearer and more coherent regulations on labor registration principles, registration procedures, information adjustment, and rights and obligations of workers in labor registration. To continue perfecting the draft Law as well as to regulate the contents under the authority of the Government, the Standing Committee of the Social Affairs Committee requests the Government and the drafting agency to note that the registration and updating of information of employees participating in compulsory social insurance must ensure that no costs arise or that any costs arise that are not taken from the Social Insurance Fund.
The construction of a database on workers and a labor market information system will incur large costs and administrative costs. Therefore, it is recommended that the drafting agency assess the impact, fully estimate the costs and administrative costs, and consider the provisions in the draft Law to ensure feasibility. Regarding unemployment insurance premium support, the draft Law of the Government proposes to supplement the support regime for employers when employing people with disabilities through unemployment insurance premium support under the responsibility of the employer. The Standing Committee of the Social Affairs Committee supports the need for this policy to support employers who employ people with disabilities, demonstrating the superior policy of our Party and State in caring for the vulnerable.
However, the draft Law currently stipulates "people with disabilities" in general, but according to the provisions of the Law on People with Disabilities, there are currently 3 levels of disability (mild disability, severe disability and extremely severe disability), the report does not have accurate statistics on workers with disabilities to be able to forecast resources accurately. In addition, the draft Law stipulates that the reduction of unemployment insurance premiums is the responsibility of employers to pay for employees with disabilities, so it is necessary to supplement the assessment of the impact on the Unemployment Insurance Fund (currently, the Unemployment Insurance Fund is almost balanced between revenue and expenditure during the year).
The Standing Committee of the Social Committee requested the Government, the drafting agency and relevant agencies to continue reviewing and eliminating overlapping regulations, focusing on regulating contents under the authority of the National Assembly, not regulating in the draft Law contents under the authority of the Government and ministries and branches. At the same time, carefully prepare draft documents detailing regulations and implementation instructions. At the same time, it is necessary to continue to carefully evaluate and clarify the contents mentioned to have appropriate and feasible regulations in the draft Law. Continue to widely collect opinions from relevant parties to ensure high consensus. Continue to more closely review the consistency and synchronization with the legal system.
Speaking at the meeting, Minister of Labor, War Invalids and Social Affairs Dao Ngoc Dung said that in the past time, the Ministry has closely coordinated with the Social Committee with a high sense of responsibility, spent a lot of time carefully studying the opinions of delegates, focused on reviewing the entire draft Law with the mindset of building new laws, therefore, this draft Law has been significantly shorter. Regarding specific content, the Minister said that regarding labor registration, this is very necessary and cannot be avoided, especially for informal workers. The draft Law only states the principles in labor registration and labor database management, while the Government will clarify more specific and detailed contents in sub-law documents.
Concluding this content, Vice Chairwoman of the National Assembly Nguyen Thi Thanh assessed that the Social Committee and agencies had carefully studied the opinions of National Assembly deputies, making efforts to concretize 4 groups of policies with many new points on flexible, effective, modern, sustainable and integrated labor market management. The Vice Chairman of the National Assembly suggested that, after the meeting, the Standing Committee of the Social Affairs Committee should preside over and coordinate with the Drafting Committee and relevant agencies to promptly receive comments at the meeting, complete the draft Law and the Report on explanation, reception, and revision of the draft Law of the Standing Committee of the National Assembly, review the technical documents, and send them to National Assembly deputies for comments according to regulations, ensuring quality and progress.
